What’s important to know as a landlord if my tenant stops paying rent?
Answer:
If your tenant stops paying rent and you have a written lease, the first thing you need to do is check the terms of the lease to determine whether you’ve provided a grace period.
Typically, I’ve seen grace periods for failure to pay rent of five days. After those five days, you need to prepare a demand for payment of rent and serve that on your tenant. Following the demand and failure to pay, you must post what’s called a “notice to quit” on the door of the unit. Alternatively, you can hand-deliver the notice to the tenant.
If the tenant hasn’t paid you what they owe and vacated after you’ve followed these steps, you’ll need to file a civil complaint seeking rent and possession of the property.
