In Delaware, the owner of a dog is liable to any person that the dog bites regardless of prior notice of vicious behavior. However, there are two exceptions. The dog owner is not responsible in the event that you are a trespasser or in the event that you are on the property illegally with the intent to commit a crime or that you are actually committing a crime or if you are bitten while committing a crime against another person physically. In those instances, the law will not allow you to recover from the dog owner.
