What Should I Do If the Employee Who Applied for Leave Has Not Returned?

There are times that a client will come to our office and speak to one of our Media Employment Lawyers and ask what to do if the injured employee that applied for leave through FMLA, has not returned to work.

• Family Medical Leave Act only applies to employers who have 50 or more employees that live in a 75 mile radius.
• Your employee will only fall under FMLA guidelines if they have worked over 1250 hours in the last 12 months.
• You can provide your employee up to 12 weeks of leave, but if they do not return you must document that you have taken steps to have the employee return.
