- You cannot outright ask an employee if they have a disability. You can ask if they will be able to perform their job duties without reasonable accommodation, if they openly disclose that they have a disability.
- If you find out that an employee has a disability later on, you can only ask about that specific disability and how it effects the job. You can also request a medical examination if the employee is unable to perform those duties because of the disability.
