Delaware County Personal Injury Attorney Elaborates on a Medical Malpractice ClaimThis legal question was provided by Avvo.com.  You can view the original question here.

Question:

I had a procedure done on my back.  During my surgery my dura sac was punctured and I had to be admitted into a hospital.  Can I sue if my procedure left me disabled with severe nerve damage?

Answer:

As an experienced Delaware County Personal Injury Attorney, I often handle these types of matters. You seem to be describing a potential medical malpractice claim against the Laser Spine Institute for injuries sustained in the course of a medical proceeding. Assuming the damage is the fault of the surgeon you may have a viable case for medical malpractice, which is a civil cause of action.

You should be aware that the statute of limitations for medical malpractice in PA is 2 years from the date of the malpractice, which in this case is likely the date of the surgery. Of course, under certain circumstances there are arguments which toll the statute of limitations until discovery of the injury. You should consult with an attorney immediately.
