What is a Medicare Consent to Release form?  My husband was in a car accident and the defendant’s attorney is asking for this form.

The Medicare Secondary Payer Act is a federal law that requires a litigant repay the government for any medical expenses paid for by government provided healthcare, when there is a recovery from a liable third party. If there is a Medicaid/Medicare lien the insurance company can be responsible if you fail to satisfy the lien. It is not uncommon for the carrier to require you execute such a document, prior to paying settlement proceeds – merely as a precaution to cover themselves.
