        Question:

        What problems should be addressed in the real estate agreement of sales for the seller?

        Answer:

        On the seller’s side of a real estate transaction, the real estate agreement should, of course, make sure that the seller gets paid. But, it should also ensure that the seller is able to complete the transaction and walk away from a closing table with as few — and if possible — no ongoing obligations to the buyer.

        When advocating for the seller, we are primarily interested in two things.
        1. Making sure the buyer is going to get to the closing. To help achieve this, we usually expect a deposit of some kind to prove the buyer has significant enough financial wherewithal to make the deal.

        2. That we’ve limited the amount of time buyers can tie up the property. Buyers need the ability to inspect the property, get financing, and so forth. Even so, as the seller, it’s important to make sure the time period to exercise these options is not unreasonably extended.

        From a seller’s point of view, you want to make sure you get paid, you want to make sure that the deal happens in a reasonable fashion and on a timely basis, and you want to walk away from the deal without any continuing obligations to the buyer.
