If I was severely injured in a car accident, who is going to pay for my medical bills?
Answer:
As a knowledgeable Delaware County Personal Injury Attorney, I get questions all the time from clients regarding paying medical bills after an accident. If you are involved in a serious automobile accident in the State of Pennsylvania, the initial phase of your medical bills is compensated by the automobile insurance policy you purchased for your own benefit. Within your policy, there are two options you can choose from regarding benefits.
The first option provides a minimum of $5,000 in medical benefits. The amount of benefits you select in this provision will be used by your automobile insurer to pay your medical bills, but it’s not uncommon for the amount to be $5,000.
The second option is the wage compensation alternative. It allows you to receive certain wage compensation, which is also usually a minimum of $5,000 in coverage. Again, you could have bought more, but it usually isn’t the case with the medical or the wages.
If you go the first route of the medical benefit, once the $5,000 is exhausted you have the right to go to your own medical insurer, either the Blue Cross or Aetna or whoever your home provider is to pay medical bills beyond the first $5,000.
When you elect to go the route of the wages provision, the process involves going to your employer and looking at either short term disability and/or long term disability, depending on how long you’ve been out. These provisions prevent payment for medical bills from being out of pocket or being taken from your wages if you’re unable to work after an automobile accident.
